The Employee Retirement Income Security Act was adopted in 1974 to protect employees enrolled in health plans provided by employers in private industry.  The law requires the Plan Administrator to provide plan information, rules, rights, grievance and appeals process and gives employees and covered family members the right to sue for benefits and for breaches of the Plan Administrator's fiduciary duties.
